End User Terms of Service & License Agreement
Effective Date: August 6, 2026
THIS END USER TERMS OF SERVICE AND LICENSE AGREEMENT (“AGREEMENT”) GOVERNS THE LICENSING, ACCESS, AND USE OF ALL HOVIS CAPITAL PLATFORMS, WEBSITES, AND SERVICES OWNED AND OPERATED BY HOVIS CAPITAL, LLC (“COMPANY”, “HOVIS CAPITAL”, “WE”, “US”).
SERVICES INCLUDE (I) ALL SERVICES PROVIDED ON HOVIS CAPITAL PLATFORMS, (II) THE WEBSITE AT HOVISCAPITAL.COM, AND (III) ALL OTHER APPLICATIONS, SITES, PLATFORMS, TECHNOLOGY APPLICATIONS, OR PROGRAMS PROVIDED BY HOVIS CAPITAL, LLC.
BY USING ANY HOVIS CAPITAL SERVICES OR ACCESSING THE PLATFORM, YOU AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS OF THIS AGREEMENT AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICES.
THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION, CLASS ACTION WAIVER, AND JURY TRIAL WAIVER IN SECTION 14 GOVERNING RESOLUTION OF DISPUTES.
01. DEFINITIONS
- Access Right: The limited, non-exclusive, non-transferable, revocable right to access and use Hovis Capital Platforms during your Subscription Period.
- AI Systems: Automated tools, artificial intelligence, large language models, neural networks, or machine learning technologies.
- Company IP Assets: All proprietary software, materials, trademarks (including Hovis Capital™), trade secrets, and content.
- Hovis Capital Platforms: Web-based platforms, courses, software, materials, customer management systems, and technical documentation provided by Hovis Capital, LLC.
- User Content: Data, documents, and figures uploaded or controlled by the User during platform usage.
02. SCOPE & CONDITIONS OF USE
2.1 Access Rights. Hovis Capital grants Users a personal, limited, non-exclusive, revocable right to access cloud-based platform features for the designated subscription term.
2.4 Prohibited Uses. Users shall not: upload unauthorized data, impersonate others, train or support unauthorized AI Systems using platform content, or violate platform security.
2.5 Educational Nature. Support consultations and materials provide general educational information and do not constitute legal, tax, or individualized investment advice.
03. SUBSCRIPTIONS & FEES
Subscriptions automatically renew unless cancelled prior to renewal. Cancellations or account management requests may be directed to inquiries@hoviscapital.com.
04. RESPONSIBILITIES & INTELLECTUAL PROPERTY
Users are responsible for maintaining account confidentiality and security. All title, intellectual property rights, and goodwill in Hovis Capital Platforms remain exclusively with Hovis Capital, LLC.
05. LIMITATION OF LIABILITY & ARBITRATION
THE PLATFORMS ARE PROVIDED “AS IS”. HOVIS CAPITAL DISCLAIMS ALL WARRANTIES. AGGREGATE LIABILITY SHALL NOT EXCEED $100. ALL DISPUTES SHALL BE RESOLVED VIA BINDING ARBITRATION ADMINISTERED BY JAMS IN DENVER, COLORADO.
